Commercial, Banking and Insolvency
Brian accepts instructions across a range of commercial and civil disputes, including breach of contract, banking and financial services claims, consumer credit, and corporate and personal insolvency. He has experience acting in winding-up petitions, statutory demands, bankruptcy, and contested debt recovery proceedings. He regularly appears in multi-track trials and complex applications.
Notable matters include:
- Trusted Brands Limited v Zempler Bank Limited: acting in a contested commercial dispute against a digital bank concerning contractual and regulatory obligations.
- HM Revenue & Customs v Medya Investments Ltd: contested winding-up petition in the High Court.
- Kiera Grant and Wayne Grant v Shaw Brooke Bank Limited: banking and financial services dispute involving consumer credit issues.
- Oberlander & Anor v Raphael (Case No. J10CL086): acted for the Defendant before a Circuit Judge at the Royal Courts of Justice in a complex boundary and easement dispute, together with committal proceedings arising from repeated breaches of court orders.
Employment
Brian acts for both claimants and respondents in employment disputes, including unfair dismissal, breach of contract, wrongful dismissal, and discrimination claims. He has experience in multi-day Employment Tribunal hearings.
Notable matters include:
- Bond & Haberfield v Bonds Utilities Services Limited (Case No. 6001004/2025): represented the Defendant in a two-day Employment Tribunal trial on breach of contract and unfair dismissal.
Personal Injury, Credit Hire and Housing
Brian has a substantial caseload of road traffic accident claims with and without personal injury, credit hire disputes, housing disrepair, and landlord and tenant matters, including possession hearings and disrepair counterclaims. He also accepts instructions in employers’ liability and infant approval hearings.
Blockchain, Digital Assets and Technology
Brian advises on the full spectrum of blockchain and digital asset matters, including cryptocurrency fraud and recovery, digital asset tracing, DeFi and DAO legal structuring, virtual asset service provider (VASP) regulatory compliance, anti-money laundering and counter-terrorist financing programme development, smart contract compliance, AI regulation, and data protection. He has spoken on digital assets at the Association of Certified Anti-Money Laundering Specialists (ACAMS), Cambridge University, Queen Mary University of London, MIT, and the London Blockchain Conference, among others.
Family and Matrimonial Finance
Brian accepts instructions in financial remedy proceedings, including FDR hearings and final hearings involving complex asset structures. He has a particular interest in the treatment of digital assets in divorce and succession, on which he has published in SSRN.
Immigration
Notable matters include:
- Elfaki v Entry Clearance Officer (HU/61992/2023): secured entry clearance for a Sudanese national in the First-tier Tribunal (Immigration and Asylum Chamber), successfully applying the exceptional circumstances framework on Article 8 ECHR grounds. The Tribunal granted the appeal and made a fee award against the Home Office.
